Please thoroughly read through this agreement to understand what information Escape Media Group Inc (”EMG”) collects about you when you use grooveshark.com and its associated desktop application (”this service”), and who EMG may share this information with. If you find any part of this policy unacceptable, please discontinue your use this site immediately, as this Policy is integrated into, and subject to the Term of Service (found at http://www.grooveshark.com/tos.php) for this service. The use of this service constitutes an agreement between yourself and EMG to knowingly accept and agree to the terms and provisions of this privacy policy.
Definitions
- Private information: Data which a user has submitted to this service, or has been accumulated by this service through its use, but is not accessible to other users via normal use of this service.
- Personally identifiable information: Data which ties a particular user’s IP address, or full legal name with an action, for example downloading a particular song via this service. If such information is public information, it is not considered personally identifiable or private.
- Public information: Data which by user preference, or architecture of this service, is available to be viewed by any user of this service. This may include, but is not limited to information on a user’s public profile, tags, comments, and or ratings submitted by a user.
Information we collect and who can access it:
- Public and private information: To provide the needed data to make this service possible, EMG collects and stores information that includes but is not limited to user information submitted during sign up, profile information, and music library information and its accompanying information such as tags, ratings, articles, and comments. EMG stores this information for an indefinite amount of time, unless otherwise specified in the Terms of Service. This information will not be shared with any 3rd party without consent from the user, or unless otherwise stated in this policy or the Terms of Service.
- Personally identifiable information: When you use this service, information about your computer’s request is saved by EMG. This data may include information such as IP address information. IP address information is stored for no more that 6 months from the date the information is recorded. This data may be stored for longer, up to an indefinite amount of time, if EMG is so ordered to do so by a United States court of law with proper jurisdiction. This may be done without any notification to the user. This information may also be kept longer than 6 months by EMG if a user is found by EMG’s soul judgment to be suspect of carrying out illegal, unlawful, or dangerous actions with or in this service. Prior to keeping IP address information for more than 6 months, the user will be notified via email about their suspect status.
In addition to recording information involving a user’s ip address as described above, EMG collects and stores personally identifiable information that includes but is not limited to information that links music downloads and streams to particular users and information that links users and there corresponding actions on grooveshark.com. This information is needed to enable certain features the service provides, and is stored for an indefinite period of time. This information will not be shared with any 3rd party without consent from the user, or unless otherwise stated in this policy or the Terms of Service. At some point in the future it is possible that users may be able to opt out of certain features and have a subset of this information not be stored for more than 7 days.
You should also be aware that if you voluntarily disclose personally identifiable information on message boards, in chat areas, or other openly viewable parts of the service, that information can be viewed publicly and can be collected and used by third parties without our knowledge and may result in unsolicited messages from other individuals or third parties. Such activities are beyond the control of EMG and this policy.
- Anonymous information: EMG records anonymous information about users which is stored for an indefinite period of time. This information records only general trends and does not link any statistic with any particular user. This data may include, but is not limited to, averages and or totals of browser and operations system types, entry and exit pages, user, artist, or album popularity, demographic information, and amount of data transferred. This information may be shared with any 3rd party EMG chooses.
Advertising
- Advertisers are given no special use of user’s private or personally identifiable information. If you choose to follow an advertisement link, do so at your own risk. EMG does not guarantee the safety or accuracy of any 3rd party site, advertisement, or product. Advertisers also have their own set of privacy and Terms of Service policies that much be carefully reviewed.
- EMG may provide any 3d party it chooses with public user information.
General
- EMG reserves the right to revise/alter this agreement at any time with no notice given. Any updates will be posted to this page, with the last updated information changed accordingly.
- Escape Media Group, Inc. does not knowingly collect or solicit Personally Identifiable Information from or about children under 13 except as permitted by law. If we discover we have received any information from a child under 13 in violation of this policy, we will delete that information immediately. If you believe Escape Media Group, Inc. has any information from or about anyone under 13, please contact us at privacy@escapemg.com.
- This policy and the use of this site are governed by the laws of the State of Delaware. If a dispute arises under this Policy we agree to first try to resolve it with the help of a mutually agreed-upon mediator in the following location: White Plains, Westchester County New York. Any costs and fees other than attorney fees associated with mediation will be at the user’s sole expense.?
- If it proves impossible to arrive at a mutually satisfactory solution through mediation, we agree to submit the dispute to binding arbitration at the following location: White Plains New York, under the rules of the American Arbitration Association. Judgment upon the award rendered by the arbitration may be entered in any court with jurisdiction to do so.
